Responsibilities will include:

Leading role in the delivery of legal counseling to WEB executives and their teams on a broad range of complex legal, business, and strategic issues, including issues related to intellectual property protection and licensing, interoperability and standards, and applicable regulatory frameworks. This position includes responsibility for coordinating with internal and external legal and non-legal expert resources, as necessary, to drive the analysis and resolution of relevant issues.

Lead counselor for the support of WEB development, marketing and distribution programs, including primary responsibility for negotiating and drafting agreements pertaining to inbound and outbound licensing, provision of services, and collaboration with partners.

Managing and delivering education and training to the WEB development and marketing organizations on relevant legal issues.

Working with the other attorneys and paralegals on the WEB legal team to provide comprehensive legal services to all levels of the supported businesses, including development of process-related improvements to facilitate and increase the efficiency of legal services.

Qualifications:
J.D. from an ABA accredited law school, excellent academic credentials.
4+ years experience as a practicing commercial attorney is required.
6+ years as a practicing commercial attorney with experience in intellectual property counseling, licensing and transactions is preferred.
Experience with copyright, trademark, interoperability, standards, advertising and/or regulatory counseling is preferred.
Outstanding analytical, writing and oral communication skills, as well as strong record of effective collaboration across distinct legal and business groups.
Sound and practical business judgment, ability to think strategically, and desire to establish a “trusted advisor” relationship with executives and key business clients.

Key Relationships: The Special Education Attorney works closely with the ISC Special Education staff, including the Committee on Special Education, and the staff in the Office of Legal Services.

RESPONSIBILITIES

    * Prepares for and/or tries complex cases involving significant precedents, novel and complicated determinations of law and fact, or having significant legal, policy or financial implications for the Department of Education.
    * Determines the advisability of presenting witnesses as well as the admissibility of types of evidence and matters of legal strategy.
    * Provides training for the ISC staff and the Committee on Special Education (CSE) clinical staff on compliance with federal and state education laws and regulations.
    * Confers with special education specialists, technical experts, and other attorneys, including counsel for litigants.
    * Negotiates and implements the settlement of special education claims.
    * Conducts legal investigations; administers meetings to confer with the ISC and CSE impartial hearings teams and clinical staff to discuss pending special education claims and other ISC and CSE special education-related matters.
    * Prepares and argues difficult cases and appeals in administrative tribunals and in the courts.
    * Reviews, revises and approves agreements prepared by other attorneys.
    * Analyzes, studies and reports on the effects of city, state and federal legislation.

QUALIFICATIONS

Minimum Requirements

    * Admission to the New York State Bar AND two (2) years of progressively responsible United States legal experience subsequent to admission to any State Bar.

NOTE: Selected candidates must remain members of the New York State Bar in good standing for the duration of their employment.

Preferred
