This in-house position will be part of a team that supports one of the most dynamic and expansive mortgage loan business in the United States. The position will report to the Assistant General Counsel for Home Loans & Insurance supporting the Reverse Mortgage and Wholesale/Correspondent/Warehouse lines of business, and will be primarily focused on reverse mortgage sales, fulfillment, product and pricing, closing services and escalated complaints (including fraud and elder abuse prevention). This candidate will: Provide legal support for the Reverse Mortgage line of business/client, including the retail bank, call center, wholesale, correspondent and wealth management channels for this line of business. The fulfillment process covers loan origination activity from application to boarding on the servicing platform. Work with the business and risk partners to develop sound, risk-based lending strategies and operational processes. Coordinate and review marketing and advertising. Counsel on origination, fulfillment and closing matters as well as product and pricing matters. Provide guidance on compliance with corporate policies and procedures and federal and state laws and regulations governing mortgage lending, including ECOA/Regulation B, TILA/Regulation Z, RESPA/Regulation X, HMDA/Regulation C, FCRA, GLBA/Regulation P, HOEPA, Fair Housing Act, federal preemption, rate exportation and various state lending and unfair and deceptive trade laws. Provide support for integration of acquisitions and related transactions. Provides general legal counsel to the consumer banking businesses, as well as specific advice on products, services and certain legal actions. Reviews legal contracts and documents. Directly, or through staff, conducts legal research. May represent the bank in legal actions. Individuals in this position typically have a minimum of five years of experience since admission to the Bar. Qualifications Minimum of 6 years of mortgage lending and consumer real estate-related experience. Candidates must have a minimum of 6 years of experience since admission to the Bar. NC bar not required; Active license in good standing necessary. Strong understanding of consumer banking regulations, including Reg Z. FHA lending expertise and knowledge of FHA guidelines required. Experience with distressed transactions and counter-party risk analysis in B2B transactions also preferred. Experience with reverse mortgage products and applicable legal and regulatory requirements, including FHA and HUD requirements applicable to HECMs is a plus.
